Mineral Rights Under Your Land May Be Owned by Someone Else
In Texas, the mineral rights under a property can be severed from the surface — meaning you could own the land but not the oil, gas, or other minerals beneath it.
Texas allows surface and mineral rights to be owned separately. If mineral rights were sold off years ago, the mineral owner can allow drilling on your property even if you object. This is called a split estate. In Johnson County, there has been some oil and gas activity.
Before you buy land, ask a title company or real estate attorney to search for any mineral reservations in the chain of title. The Railroad Commission of Texas (rrc.texas.gov) tracks drilling permits and well records. You can search for wells in Johnson County on the RRC website.
