Rural Homes Need a Septic Permit Before Building

Homes outside city sewer service in Montgomery County need a permitted on-site sewage system before construction can begin.

If your property does not hook into a city or MUD sewer, you need a septic system. The official term is On-Site Sewage Facility (OSSF). Texas law says you must get a permit and an approved plan before you install, change, or fix an OSSF. Montgomery County's local permitting office handles these approvals under state rules set by TCEQ.

There is a limited exemption for properties 10 acres or larger that meet all TCEQ rules. But most suburban and rural lots in Montgomery County do not qualify. Before buying rural land, make sure the lot can support a septic system. A proper site evaluation will tell you. More information is at tceq.texas.gov/permitting/ossf.
