Right to Farm
Texas law protects farming operations from certain nuisance lawsuits
If you move near an existing farm or ranch in Kaufman County, Texas law limits your ability to sue the operation as a nuisance.
Texas has a Right to Farm law. It protects farms, ranches, feedlots, and orchards from certain lawsuits. If a farm was already running before you moved nearby and has not changed much, you generally cannot sue it over noise, smell, or dust. Kaufman County still has active farmland despite its rapid growth.
This matters if you are buying rural or semi-rural property. Moving next to a working farm does not force the farm to shut down. The law only protects operations that were running without major changes for at least one year before you filed a complaint. Learn more through Texas A&M AgriLife Extension.
